Not on Record EP#215 | She Read the Affidavit. Then Her Story Changed.

Our thanks to Douglas for this. He writes:

“This one needs explaining to make it relevant to the UK. There are, in many countries, pressures to follow the Canadian system talked about in this video, sometimes only on domestic violence cases, sometimes wider.

The problem is that a defence must state what their defence is. Before court. Before the chance to cross-examine and find out just what evidence is being presented by the accuser.

So an accuser gets to know, before appearing in court, what the alibis the defence will rely on. The defence cannot know the full accusation details before going in to court.

And this is beginning to be built up as a good idea in the halls of power in the UK!

This is part of an ongoing series by a legal company who often highlight legal issues created by what we would call feminist-inspired laws.”
