Our thanks to Groan for reminding us that the Law Commission consultation on hate crimes ends in five days’ time, 24 December. The overview is here, more information on the project here, the (544-page) full consultation paper here, the (24-page) summary of the consultation paper here. I would urge you to complete the consultation questions, they shouldn’t take more than 10 minutes unless you add plenty of commentary (which you should, if you can spare the time).
Chapter 12 (Gender or Sex) of the full consultation paper will be the subject of the rest of this blog piece. It spans pp. 230-277, but you’ll need to add 11 to the page numbers in the search box to get to the correct page e.g. key in p.241 to reach p.230.
The 47 pages of Chapter 12 are little more than feminist propaganda from beginning to end, with all the myths and lies we’ve come to expect. It would take a week to critique it from beginning to end, so I’ll just highlight a few examples of the mischief. The page numbers I’ll give are those printed on the report, so add 11 to reach the correct pages. The next two paragraphs are over pp.233/4:
12.20 The Department for International Development notes that “VAWG is the most widespread form of abuse worldwide, affecting one third of all women in their lifetime”. It can take a range of forms including (but not limited to): intimate partner violence (“domestic violence”); sexual violence (including sexual violence as a tactic of war); acid throwing; honour killings; sexual trafficking; female genital cutting / mutilation (FGC/M); forced and child marriage.
12.21 There is a wealth of evidence that women and girls are disproportionately impacted by these types of crimes.[27] [J4MB emphasis. Nonsense on stilts, for a number of the crimes cited. Footnote 27 reads, “This evidence will be considered in more detail below.” Why limit “genital cutting / mutilation” to FEMALE GC/M? Because that’s the only way to present females as being disproportionately the victims, when they’re very clearly not. I doubt that even 1.0% of victims of GC/M are female.] More recently, the targeting of women for online harassment and abuse has emerged as a significant concern; an issue we noted in our 2018 Scoping Report on Abusive and Offensive Online Communications.
We turn to the section on “Violence Against Women and Girls” (pp.233-6). Just two paragraphs, at the end, relate to male victims:
12.28 As we will evidence below, women and girls are disproportionately victims of the crimes associated with VAWG. [J4MB emphasis: Even if this were true – which it isn’t – what is it doing at the start of a section on male victims? It is, ironically, a manifestation of the report writers’ misandry.] However, the Crown Prosecution Service (CPS) notes that:
The CPS applies policies fairly and equally to all victims, both male and female, and we are committed to securing justice for all victims. Prevalence studies of these crimes evidence the disproportionate experience of females {J4MB emphasis: Presenting the same lie once is clearly not enough in this short section] however the CPS recognises the experience of male victims and its distressing impact on them. [J4MB: The CPS recognizes that experience? Well, whoop-de-do!!! What is their other option, NOT recognizing that experience?]
12.29 We recognise that men and boys can be victims of crimes associated with VAWG [J4MB emphasis: “can be”? How about the truth, “are”? Would the Law Commission write a report stating that BAME people “can be” victims of crimes?”] and can face various barriers to reporting created by gender myths and stereotypes.
On p.248:
12.78 We also acknowledge that men are victims of sexual offences and domestic abuse in a minority but nonetheless substantial number of cases. 16.1% of CPS prosecutions for rape in 2018-19 involved male complainants. [J4MB emphasis. Under the Sexual Offences Act, 100% of rape perpetrators are male, because only penile insertion is defined as rape.] In 2018-19, where the sex of the complainant was recorded, men constituted 17.5% of complainants in domestic abuse flagged prosecutions. For the most part, sexual offences or domestic abuse cases which involve a male victim also involve a male perpetrator. [J4MB emphasis: Two more feminist myths.]
