Our thanks to Jake for this. We covered paternity fraud in our last general election manifesto (pp.52-4).
Jake writes:
Another case of a “learned” family judge, Justice Cohen, failing to recognise any harm done by paternity fraud, and refusing a refund of child support / money spent on the child or any form of compensation payable by the fraudulent ex-wife to the aggrieved ex-husband.
Paragraph 40 is particularly egregious:
“I disagree that by taking on pecuniary responsibility for C H has satisfied the requirement that he must give credit for the benefit received. The benefits of having a much loved child in a party’s life is not to be measured purely in expenditure made.”
Disgusting demonstration of the empathy gap. Babies mistakenly swooped at birth by incompetent hospital staff? Very different judgement made.
