Notts Police arrest three people in connection with a case of MGM – suspected Grievous Bodily Harm (GBH) with intent. Maximum penalty, life imprisonment.

Our thanks to Tim for alerting us to a piece published 16 hours ago on the Notts Police Facebook page. It reads:

Three arrested in child circumcision investigation

Officers investigating the circumstances surrounding a circumcision conducted on a child in July 2013 have arrested three people today (Wednesday 21 June 2017).

A 61-year-old man was arrested on suspicion of grievous bodily harm with intent.

A 44-year-old man and a 47-year-old woman were arrested on suspicion of conspiracy to commit grievous bodily harm.

They have all been released pending further investigation.

Our enquiries are ongoing.

The maximum penalty for GBH with intent under the Offences Against the Person Act 1861 is life imprisonment.

  1. So it magically becomes GBH if the mother doesn’t consent? So if she had consented to harming her child, it would magically not be GBH?

    Do police and lawyers have to acquire degrees in fallacious logic?

    • Some maybe. But actually it’s a clever move. If a prosecution for GBH goes ahead, ostensibly based on the lack of maternal consent, it puts circumcisers in the uncomfortable position you just outlined. They will then have to argue that GBH suddenly becomes not GBH the moment there is parental consent. And there is already established British case law that no one can consent to assault, not even upon themselves. Saimo Chahal knows exactly what she is doing, and the implications of this are huge. That’s why we can expect massive opposition to this case, some of it underhand no doubt.
