  1. A sorry tale mirrored in the UK. There are few very simple “perverse incentives” in our system even before looking into the detail. Most obviously the massive increase in accusations of Child and or Domestic Abuse immediately following the cessation of legal aid in family courts unless there is suspected Abuse. I recall in some areas the accusations tripled as law firms got onto this lever to get legal aid.

    Secondly the creation of various “go” orders applied by magistrates only on accusation, requiring no proof, which effectively eject fathers from their home and apply restraining orders on contact.

    Thirdly the refusal of Courts to actually enforce their own orders even when they are agreed to have been broken by the mother.

    Of course there are many other more subtle things going on with CAFCASS etc. But these three are pretty damning on their own.
