The court said it was opening the investigation in light of the “unequivocal nature” of Hermoso’s statements, saying it was necessary “to determine their legal significance”.
“Given the public statements made by Jennifer Hermoso, the sexual act she was subjected to by (Luis) Rubiales was not consensual,” a statement said.

I note that the court is looking into the possibility something illegal has happened, while saying any action will rely on a case being brought with a complainant. I notice that Hermoso’s “statements” which are very brief began with a denial she was upset and have shifted over time as her union and others make statements on her behalf. The furor starts to look political given even the BBC refers to parts of the socialist led coalition as “far left” “Diaz, who is also deputy prime minister and head of the far-left Sumar coalition, called for social attitudes to change more generally in the country – and for victims of sexual harassment and violence to be better protected”. It looks more and more like Rubiales is a pawn in a political game to do with Spain’s polarised politics. As we know even knee touching in this country can somehow be linked to “sexual harassment and violence”. Time will tell whether Jenni Hermoso goes to the police with the “advice” of the Prosecutor’s office, it seems pretty evident her Union and left Politicians will propel her to do so. Spain has an inquisitorial system with few protections for the accused.
