  1. What gets lost in this is the simple fact that the accused is prosecuted by “the Crown” and thus is fighting the full might of the state. (In the form of the police and CPS). The honesty of the judge and existence of a jury are what ensures that the crown has proved “beyond reasonable doubt” that the man deserves the harsh punishments (prison and being put on a “register” ) meted out to the guilty. Rightly juries take this seriously.

  2. One problem, that is shown in the research on ” rape myths” , is the divergence between the rhetoric about “rape” and modern reality. The rhetoric is still in the language of the last century as some fate worst than death that sullies women and their virginity. Whereas the juries are often confronted by cases of two promiscuous people fully taking advantage of the sexual revolution to indulge in sex as a free and easy recreation often while inebriated or stoned. Unsurprisingly in such muddy waters juries regard there to be reasonable doubt! The real myth is the idea that “rape” actually means the same as it did in a society that no longer insists on sexual fidelity no regards intercourse as a serious act.
