Australia: Sarah Winyard, 21, driver, causes the death of Graham Jurott, 87, motorcyclist. Female magistrate. Community service.

Our thanks to Martin for this. An extract:

Doc [J4MB: Jurott’s son] says he cannot understand why the woman was not charged with dangerous driving causing death which carries a maximum sentence of 10 years.

“For some reason the cops went light on her. The magistrate (Justice Hay) questioned that herself.”…

Justice Hay took into account the driver’s mental condition following the traumatic crash. [J4MB: Why? What earthly relevance does this have on the punishment she deserved?]

Doc says Justice Hay told the court a conviction would have a negative impact on Sarah’s ability to assume her aspirations of studying to be a social worker with refugees. [J4MB: Heaven forbid that killing an 87-year-old man should have any negative consequences for a woman.]

“For some reason the cops went light on her”. Hmm, what might that be?

  1. Quote:

In the same way that her actions had a negative impact on the right of the victim to go on living?

But but then he was old (and a man) so was going to die soon anyway.
And we NEED more social workers to help economic migrants bleed the system and undermine it further.

    The logic is all there

  2. We’re seeing more and more of this. Judges are mostly concerned about what effect the sentence will have on the criminal, when the criminal is a woman.

    • It’s just a ruse to avoid punishment, as in so many cases with women. Prospective employers will google search her name and come up with the story.

  3. Ouch, working to be a social worker with refugees. OTOH it says in the link that it was the cops who went easy on the driver, not (or not just) the magistrate. Disappointing all round.

    • She has an ‘aspiration’ to be a social worker with refugees. I have an aspiration to score a hat-trick in Scotland’s World Cup final victory against Germany next July, but I’m guessing wildly that won’t happen. Her story may be a cost-free fiction to increase the leniency shown to her – after all, who is going to pay attention to whether or not she does that?

    • The ‘social worker’ aspiration is most likely contained in the pre-sentencing probation report that goes before the court in other words a good sob story.for the magistrate to consider…..appears to have worked well.

  4. Causing death on account of ‘driving without due care and attention’ can reasonably be substituted with the term ‘manslaughter’. According to the degree recklessness inherent in the action ‘without due care and attention’, it may be more reasonable to substitute with the term ‘murder’. It is beyond belief that the man-killer Sarah Winyard has apparently had ‘no crime recorded’ against her evil name.
