Psychological impact of being wrongfully accused of criminal offences: A systematic literature review.

“Being wrongfully accused of criminal offences can lead to serious negative consequences to those wrongfully accused and their families. However, there is little research on the psychological and psychosocial impacts of wrongful accusations. We conducted a systematic literature review to collate the existing literature, searching four electronic literature databases and reference lists of relevant articles. Data were extracted from 20 relevant papers, and thematic analysis was conducted on the data. Eight main themes were identified: loss of identity; stigma; psychological and physical health; relationships with others; attitudes towards the justice system; impact on finances and employment; traumatic experiences in custody; and adjustment difficulties. The psychological consequences of wrongful accusations appear to affect the lives of those accused seriously, even after exoneration or overturning of convictions. Strategies for improving public perception of wrongful convictions should be explored, and specific mental-health systems should be established to support those who are wrongfully accused.”

South Korea: “After Apartment Noise Dispute, Woman in Her 30s Convicted of False Sexual Assault Accusation Out of Spite.”

“She repeated the same claim during an interview at the Women and Juvenile Affairs Division of Chuncheon Police Station in April of the same year. However, a police investigation found that there had been no physical contact between the two during the altercation.

The court stated, “False accusations not only cause significant financial and psychological distress to the accused but also hinder the fair exercise of the state’s criminal justice authority, so it is necessary to punish such acts strictly.” Regarding the sentencing, the court explained, “The sentence was determined by taking into account that the defendant eventually admitted her wrongdoing and confessed to the crime.”

So the court recognised “False accusations not only cause significant financial and psychological distress to the accused… ” but gave the woman a suspended sentence anyway, because vagina. I’ve never heard of a convicted male criminal escaping prison on the grounds of admitting his wrongdoing and confessing to the crime.

Prison officer Megan Breen, 23, pregnant single mother, carer for another child, given suspended sentence for inmate affair

Same old, same old. Women should not be prison officers in men’s prisons, full stop. Near the end of the piece:

“Judge Tracey Lloyd-Clarke said Breen showed “remorse”, did not pose a danger to the public, and noted her pregnancy and childcare duties as key reasons for suspending the sentence.

She said immediate custody would harm others, including Breen’s son, unborn child, and the child she cares for, making this an “exceptional case”.”

What would have been “extraordinary”? Immediate custody.
