  1. This story shows how public services do not follow the Law. English courts defy own ruling on trans toilets In this case in adjudication in the feminist civil war over toilets the supreme Court pointed out the “sex” in the Equality Act meant biological sex because its clear that’s what parliament meant. Not least because later in a separate piece of legislation they had to describe the difference to deal with sex change processes and documentation to recognise “gender reassignment” (clearly there has to be a sex you’ve changed from and to!). However public services do not follow the Law but do follow the “Guidance” from the relevant Ministries or Quangos. Hence no change until the Guidance is changed. This reliance on Guidance is why many things that are quite simply illegal are still done. For example: “Non Crime Hate Incidents” and their recording. Declared unlawful by the Courts but still recorded by most Police Forces. “Gendered” treatment of Domestic Abuse and Coercive Control despite the Legislation being sex neutral, guided by Guidance and the VAWG Strategy. “Positive Discrimination” in hiring, promoting and dispersing Gov. loans and grants despite Court rulings declaring all these unlawful. Of course it suits the public servants to do this because they are sympathetic to the PC (now “woke”) agendas the guidance tends to follow. The get out clause in all this is that until there is a case so clear that the “guidance” is clearly wrong and it is rescinded there is both the opportunity to take time, sometimes years, to issue new guidance or make minor changes and hope no one who is determined (and has deep pockets) to take it to the Courts for a clarifying case. The TERF wars have also shown how often Ministries or Quangos have simply relied on Lobby groups or “Charities” to draft guidance for them (Stonewall being a very clear case of this as the relevant Ministries “go to” for such until the whole “trans thing started to fall apart). This is of course how an awful lot of feminist policy gets into public services, even though it is dubious and not infrequently unlawful.
