This story shows the way in which the law is often flouted. The Councillor rightly points out that giving preferential treatment based on sex is morally wrong. But in fact the proposed method,“access to funding for skills bursaries will be prioritised for women through preferential scoring in applications” would actually be illegal. It is not only morally wrong to score applications differently based on sex but it happens also to be illegal. If a standard test results in an equal score then it is legal to preference the “under represented” sex (or race, etc.) However giving applicants extra points based on their sex is just plain illegal. Unfortunately this practice is all too common and most people assume its legal. Sadly too few men who are discriminated against in this way realise this and seek legal redress.
