This is an exellent explanation of the law. It also makes a very very important point that the key to denying men their legal rights is not the legislation itself . But the guidance/ policy issued by key agencies involved. In this case this guidance effectively means that men will not be helped to get justice because those they are likely to go to for help will have been “guided” to assume tests cannot be done without the mother’s agreement. As Mr. Collins points out the guidance is unlawful in terms of not actually being the legislation. However few men will know this if those they rely on are told to say something actually untrue.
This is important because in many cases it is this guidance that is used to deny men justice rather than laws themselves. Another example is family law and the children’s act. Where the law itself is child centred but the operation of CAFCAS etc. is not. Another egregious example is the influence of VAWG policy which skews public agencies to ignore male victimisation.
Legislation is mainly ” gender neutral” the sexism comes in the guidances and policies of the agencies involved.
