Tiger Woods is suing his former lover after she broke an $8 million gagging agreement, which stopped her speaking publicly about the superstar golfer.
Rachel Uchitel signed a 30-page non-disclosure agreement (NDA) in 2009 after having an affair with Woods, who at the time was married. The deal, paid in three instalments over three years, was estimated to be worth about £4.8 million at 2009 rates and it prevented her from talking about the golfer with anyone.
With the money, she moved to a flat in New York’s Upper East Side, but this year she took part in the HBO documentary Tiger, about the golfer’s life. “I wanted for once to be the one to narrate my story,” she told The New York Times.
After appearing on the documentary, Uchitel filed for bankruptcy, having spent what she earned from the agreement with Woods — much of which went on lawyers’ and other fees.
Michael Holtz, one of Woods’s lawyers, is now challenging her bankruptcy in order to bring an action against her violation of the NDA.
The agreement with Woods’s team was more restrictive than most gagging clauses. It prohibited Uchitel from discussing “directly or indirectly, verbally or otherwise”, Woods’s “lifestyle, proclivities, customs, private conduct, fitness, habits, sexual matters, familial matters”, among other topics, with anyone. It also forbade her to say she had signed the deal.
Uchitel, 46, claims she has fallen on hard times and can only find work related to her reputation, including being a spokeswoman for a “sugar daddy” website.
She was one of several women to have had affairs with the golfer while he was married to Elin Nordegren. The couple had two children before she sued for divorce in 2010.
